The New Orleans Teacher Job Board website, located at https://neworleansteacherjobboard.org/ and its related downloadable applications and services is owned, operated, hosted, and maintained by NEW SCHOOLS FOR NEW ORLEANS, INC. (“NSNO” “we,” “our,” or “us”), a Louisiana non-profit corporation. These Terms of Use (“Terms,” “Terms of Use,” “Terms of Service,” or “Agreement”) apply solely to the New Orleans Teacher Job Board and any other website owned, operated, and maintained by NSNO (collectively, the “Website”). The terms "you," "your," and "user" (collectively the “Users”) refer separately to each person (each individual and each entity for whom the individual acts) that accesses or uses this Website, regardless of if such user is a visitor, an employer or a job seeker.
Please read these Terms of Use carefully before using our Website. By using our Website, you are making a binding agreement with us, subject to these Terms of Use. NSNO reserves the right to modify these Terms & Conditions at any time. Your continued use of our Website means that you consent to any changes we may make to our Website or Services at our sole discretion.
If you are under the age of 13 do not use this Website. If you are under the age of majority in your state (if you are a minor), do not use this Website without consent of a parent of legal guardian.
Services Provided:
Our Website provides a job board that enables Users who are job seekers (”Job Seekers”) to find, connect with, and apply to employment opportunities (“Jobs” or “Job Listings” or “Job Posts”) posted by Users who are employers (“Employers”). The Jobs are related to available positions within public schools in New Orleans, Louisiana. Job Seekers and Employers may register and create profiles and accounts on our Website. Employers may post Jobs, and Job Seekers may search for and apply to the Jobs by submitting applications and resumes. The Website and its associated services are collectively referred to as the “Services” we offer.
As part of its Services, NSNO may make available Job Listings, including employment opportunities and other job-related content, and links to third-party websites. Searching for Jobs on NSNO is free for Job Seeker. Job Listings are created and provided by third parties over whom NSNO has no control whatsoever. Users acknowledge and understand that NSNO has no control over the content of Job Posts, links to or from Job Posts, or any conditions third parties might impose once a Job Seeker has submitted an application or left our Website. If you leave our Website and choose to enter a third-party website, you accept any terms and conditions imposed by that third-party.
Employer websites may have conversion trackers or use APIs and other functionality provided by NSNO or other parties, which informs us that an application has been completed on an Employer site or gives that Employer other information about your browsing habits. While an Employer who installs such functionality is required by applicable law to provide notice and obtain any prior consent, you acknowledge and agree that NSNO has no control over such an Employer, its website, or how that website interacts with and collects information from and about you. You agree to our use of, and receipt of information from, any such conversion tracker functionality.
You acknowledge that we cannot confirm the accuracy of any Job Post or other information submitted by any Employer. We assume no responsibility, and disclaims all liability for the content, accuracy, completeness, legality, reliability, or availability of any Job Job Posts, screener questions and responses, and assessments. In addition, our website may allow you to search for or refine Job Posts based on certain criteria that you select. We take no responsibility for whether such search results are accurate.
If you are a visitor or a Job Seeker, you may not use our Website or its contents for any purpose other than personal non-commercial use. If you are an Employer, you may not use our Website for any purpose other than to hire qualified candidates. You may not resell or transfer access to the Jobs or any User to any other party. No user may use our Website for any criminal purposes whatsoever. If we determine that you have misused, criminally used, or otherwise hacked User data on our Website, we reserve the right to 1) immediately terminate your account; 2) turn over all of your submitted account data to any law enforcement agency; 3) provide any identifying information, including your IP address and usage of our Website to any governmental agency that may seek enforcement upon you.\
Terms for Employers:
Without limiting the prohibitions in the User Agreement or any other applicable agreement, you agree that you will not, and you will not enable or authorize any third party, by virtue of the Job Posts or our Services, to:
NSNO may, in its sole discretion, modify or terminate any part or all of your Job Posts or suspend your ability to use the Services. We may reject or remove any Job Post at any time for any reason, regardless of whether or not such Job Post was previously accepted or published on our Service.
Intellectual Property and Privacy:
All Employer Users hereby grant to NSNO a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to use, copy, modify, distribute and publish your Job Posts in connection with the performance of our Services (including for marketing and promotional purposes). You represent and warrant that you own or have all necessary rights (including intellectual property rights) to your Job Posts (including to grant the license above).
You may use information resulting from the Services only on an aggregate and anonymous basis to assess the performance and effectiveness of your candidate search using the Services and to optimize your candidate search. You agree to use reasonable measures to protect the confidentiality Job Seekers and to use appropriate security safeguards to protect such data in accordance with industry standards and the privacy laws of various jurisdictions, including but not limited to GDPR, CPRA, and the Massachusetts privacy law. You may share Job Seeker data only with someone acting on your behalf, provided that you are responsible for ensuring their respective compliance with these Terms of Use and for limiting their respective use of the data on your behalf. Without limiting the foregoing, you shall not (i) sell Job Seeker data; (ii) combine the the data with any data obtained by or on behalf of another employer; or (iii) except for use solely on your own behalf in a manner that does not identify Job Seeker data as associated with us, transfer any Job Seeker data (including anonymous, aggregate, or derived data) to any job search service, job postings board, data broker or other monetization related service.

Liability and Indemnity:
Under no circumstances shall NSNO or its affiliates, or its or their third-party licensors, be liable to any user on account of that user’s use or misuse of or reliance on the site. Such limitation of liability shall apply to prevent recovery of indirect, incidental, consequential, special, exemplary, and punitive damages whether such claim is based on warranty, contract, tort (including negligence), indemnity, or otherwise, even if NSNO or its affiliates, or its or their third-party licensors, have been advised of the possibility of such damages, and notwithstanding the failure of essential purpose of any remedy. Such limitation of liability shall apply whether the damages arise from use or misuse of and reliance on the site, from reliance or damage caused by information posted on the site, from inability to use the site, or from the interruption, suspension, or termination of the site (including such damages incurred by third parties). This limitation shall also apply with respect to damages incurred by reason of other services or goods received through or advertised on the site or received through any links made available on the site. This limitation shall also apply, without limitation, to the costs of procurement of substitute goods or services, lost profits, or lost data. Such limitation shall further apply with respect to the performance or non-performance of the site or any information or merchandise that appears on, or is linked or related in any way to, the site. Such limitation shall apply notwithstanding any failure of essential purpose of any limited remedy, and to the fullest extent permitted by law. To the extent permitted by law, the maximum aggregate liability of NSNO and its affiliates, and its and their third-party licensors, for all damages, losses and causes of action, whether in contract, tort (including negligence) or otherwise, shall be limited to $100.00.
You agree to indemnify NSNO and its affiliates, and hold us harmless from any damages, losses and costs (including, but not limited to, reasonable attorneys' fees) related to third party claims or proceedings, arising out of or related to your Job Posts, use of the Services, any candidate hiring or employment decisions, and breach of these Terms of Use.

We use cookies and similar technologies such as pixels, local storage and mobile ad IDs (collectively referred to in this policy as “cookies”) to collect and use data as part of our Services, as defined in our Privacy Policy, and which includes our sites, communications, mobile applications and off-site Services. Any disputes shall be resolved via binding arbitration in New Orleans, Louisiana, and you agree that you are subject to personal jurisdiction in New Orleans, Louisiana, regardless of where you live or from where you have accessed our Website.
Severability:
If any provision in these Terms of Use are unenforceable, a court of competent jurisdiction may sever such provision but shall not invalidate the entire Terms and Conditions.
